Klover Banking Cash Back Rewards Terms and Conditions

1. Eligibility and Enrollment
This Klover Banking -Cash Back Program agreement (“Agreement”) contains the Terms and Conditions that apply to your use of the Service. It is a contract between you and us, and by registering for or being authorized to use the Service you agree to be bound by the terms and conditions of this Agreement (including all agreements and policies referenced in this Agreement or otherwise applicable to use of specific features of the Service which are required to be agreed to and accepted before use of such specific features). If you do not agree to the terms and conditions of this Agreement (including all agreements and policies referenced in this Agreement or otherwise applicable to use of specific features of the Service which are required to be agreed to and accepted before use of such specific features), you may not use or access the Service.

To be eligible for the Cash Back Program, you must have a Klover Spending Account (“Account”) with Blue Ridge Bank, N.A. You will be eligible to earn Cash Back Rewards on your very first purchase with the Klover Visa® Card provided your Account is open and in good standing. No other eligibility requirements apply to the Cash Back Rewards Program.

The Cash Back Program is provided to you by Klover. Klover is a financial technology company and not a bank. The Account and all banking services are provided by Blue Ridge Bank.

2. Earning and Receiving Rewards
Eligible purchases must be made with the Klover Visa® Card. Klover Cash Back Rewards are calculated based on the percentage of each purchase. The Cash Back Program enables you to earn one percent (1%) rounded down to the nearest cent in Cash Back on each purchase made with your card and apply the Cash Back directly to your Account balance. Rounding means that you will not earn a fraction of a penny in Cash Back. For example, a purchase of fourteen dollars and fifty cents ($14.50) would earn Cash Back in the amount of fourteen cents ($0.14).

Cash Back will normally be applied as cash to your Account daily on all purchases that are settled on that day. Application of rewards may fall outside of the actual date you made your purchase. Cash Back will accrue in your Account balance, you do not need to claim Cash Back and you can use applied Cash Back just as you would the rest of your Account balance. There are no caps or limits on the amount of Cash Back earned. Klover is not responsible for any delays, failure to deliver, or miscalculations of Klover Cash Back Rewards amounts. This program may change or end at any time.

Only point-of-sale transactions with merchants for the purchase of consumer goods or services (“Purchases”) that result in a debit to your Account are eligible for Cash Back Rewards. Transactions that are not for personal, family, or household purposes (e.g., business or commercial transactions) do not qualify as Purchases. In addition, ATM transactions, Fees, Payments or Wires, Bill Pay transactions, Cash Advances, the purchase of money orders or other cash equivalents, and loan payments or Account funding made with your debit card are not eligible for Cash Back Rewards as they are not Purchases. In addition, Purchases made using third-party payment accounts (services such as Venmo® and PayPal®, who also provide P2P payments) are not eligible for cash back rewards. Returns, reversals, cancellations, disputes, or adjustments will not earn Cash Back Rewards. Cash Back will not be reversed in the event a return, reversal, cancellation, or dispute occurs. Apple, the Apple logo and Apple Pay are trademarks of Apple Inc., registered in the US and other countries. Venmo andPayPal are registered trademarks of PayPal, Inc.

Any Cash Back earned shall continue to be available for your use, provided that you remain an account holder in good standing.  Cash Back does not expire but if your Account is closed or terminated for any reason whatsoever, all Cash Back earned but not applied to your Account will be forfeited.  

We reserve the right to terminate or suspend your access to the Cash Back Program at our sole discretion.  This includes if we suspect that you have (1) engaged in non-Purchase transactions with your card intended to simulate Purchase transactions; (2) engaged in excessive Purchase transactions that were returned, reversed, or cancelled for the purpose of generating Cash Back; (3) otherwise abused the Cash Back Program; (4) violated any of the Cash Back Program terms and conditions; (5) acted in a manner inconsistent with applicable laws, regulations, or ordinances; (6) engaged in any activity which would jeopardize the Program or its intended use; or (7) engaged in any fraudulent or inappropriate acts, including by attempting to defraud Klover into providing Cash Back. If your access to the Cash Back Program is terminated or suspended, you will forfeit any Cash Back that has accrued but has not yet been paid to your Account.

3. Privacy and User Consent for Data Sharing
Transaction amounts, status, and transaction types will be used to calculate the amount of rewards to credit to your Accounts. By opting into this Program, you license and authorize us to access your Account and transaction information from Blue Ridge Bank, on your behalf as your agent, and you expressly authorize Blue Ridge Bank to disclose your information to us.
